Terms of Service

These Terms of Service ("Terms") form a legal agreement between you and TradeForge. They govern your use of the TradeForge website, journal, analytics, calculators, education centre, and every related feature (collectively, the "Service"). Please read them carefully — they include important provisions about trading risk, limitations on our liability, and how disputes are resolved.

1. Acceptance of these terms

By creating an account, starting a free trial, paying for a subscription, or otherwise using the Service, you confirm that:

• You are at least 18 years old.
• You have the legal capacity to enter into a binding contract.
• You are not barred from using the Service under the laws of your jurisdiction.
• You agree to these Terms, our Privacy Policy and our Cookie Policy.

If you don't agree, don't use the Service.

2. What TradeForge is — and isn't

TradeForge is a trading journal and education platform. It helps you record, structure and review your own trading decisions inside a 5-timeframe top-down workflow, calculate position sizes, and learn ICT methodology through structured curricula.

TradeForge is not:

• A broker, exchange, dealer or financial-services provider.
• A registered investment advisor, portfolio manager or fiduciary.
• A signal-distribution service, copy-trading platform or trade-execution venue.
• A custodian of money or assets.

Nothing displayed on TradeForge — including the calculators, model templates, education content, mock charts, analytics or community-shared setups — constitutes investment advice, a recommendation, a solicitation, or an offer to buy or sell any financial instrument. You alone are responsible for every trade you take.

You must provide accurate information when signing up and keep it up to date. You are responsible for maintaining the confidentiality of your password and for every activity that occurs under your account. Notify us immediately at security@tradeforge.app if you suspect unauthorised access.

One person, one account. You may not share, transfer or sell your account credentials.

5. Subscriptions & billing

• Paid plans (Starter, Pro, Elite, Trading Rooms) renew automatically at the end of each billing cycle (monthly or annual) until you cancel.
• Prices are listed on the pricing page. We may adjust prices with at least 30 days' notice; new prices apply at your next renewal.
• Payments are processed by Stripe (USD/GBP/AED/AUD), Paystack (NGN/GHS/ZAR), Flutterwave (NGN/GHS/KES/ZAR) and Safaricom M-Pesa (KES). Local taxes are added at checkout where required.
• If a payment fails, we may suspend access until the balance is settled. After 14 days of non-payment we may downgrade or terminate the account.

6. Free trial

Every new account begins with a 14-day free trial of the Pro tier. No payment method is required to start the trial. At the end of the trial, your account automatically reverts to the free Starter limits unless you upgrade to a paid plan. We'll email you a reminder 3 days before the trial ends.

7. Cancellations & refunds

• You can cancel any time from Settings → Billing. Cancellation stops the next renewal; you keep access until the end of the period you've already paid for.
• Where required by consumer-protection law (e.g. the EU/UK 14-day cooling-off period), you may request a refund of your most recent payment within 14 days of that payment, provided you have not exported your full data archive in that period.
• Outside statutory rights, all paid subscription fees are non-refundable.
• Annual plans cancelled mid-term are not pro-rated.

8. Acceptable use

You agree not to:

• Use TradeForge to break the law or facilitate illegal activity.
• Reverse-engineer, decompile, scrape, mirror or attempt to derive the source code of the Service.
• Run automated scripts against TradeForge except via APIs we have publicly documented.
• Resell, sublicense, white-label (outside the Trading Rooms tier) or commercially redistribute the Service.
• Upload malware, attempt SQL injection, brute-force credentials, probe for vulnerabilities outside an authorised disclosure programme.
• Impersonate another person, misrepresent your affiliation, or scrape other users' community-shared setups.
• Use the Service to harass, defame, threaten or otherwise harm anyone.
• Upload trade screenshots or playbook content that infringes a third party's copyright.

We may suspend or terminate accounts that breach these rules, with or without notice depending on the severity.

9. Your content

Your journal entries, screenshots, playbooks, tags and trade logs ("Your Content") belong to you. We claim no ownership of them. By uploading Your Content, you grant TradeForge a worldwide, royalty-free, non-exclusive licence to host, store, back up and display it for the sole purpose of operating the Service for you.

If you choose to share content publicly through Community Circles or shared setups, you grant a separate licence permitting other users to view it within the Service. You can revoke that public licence at any time by making the content private or deleting it.

You are solely responsible for the legality of Your Content. Don't upload anything you don't have the right to upload.

10. Our intellectual property

TradeForge, the wordmark, the logo, the engraved typography, the structure of the 5-timeframe journal, the confluence-gate workflow, the calculators, the education-module structure and all underlying code are the intellectual property of TradeForge and its licensors (including Tundu Trades for the methodology content). They are protected by copyright, trademark and trade-secret law.

Your subscription gives you a personal, non-transferable, non-exclusive, revocable licence to use the Service for as long as your account is active. It does not grant you any other rights.

11. Third-party services

TradeForge integrates third-party services (e.g. Stripe, Paystack, Flutterwave, Safaricom M-Pesa, Supabase, Vercel). Your use of those services is governed by their own terms. We're not responsible for outages, data handling or content delivered by third parties.

Where TradeForge displays broker names (Exness, FP Markets, IC Markets, etc.) for the MT4/MT5 import feature, those brokers are not affiliated with TradeForge. We don't endorse any specific broker.

12. Disclaimers & warranties

TradeForge is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties — express, implied or statutory — including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy and uninterrupted operation.

We do not warrant that the Service will be error-free, secure or available at all times. We do not warrant that any content, education module or model template will result in profitable trading.

13. Limitation of liability

To the fullest extent permitted by law, TradeForge, its officers, employees, contractors and licensors shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages — including lost profits, lost trading opportunities, lost data or trading losses — arising from or related to your use of the Service, even if we have been advised of the possibility of such damages.

For any direct damages, our total aggregate liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) USD 100.

Some jurisdictions don't allow these exclusions or limitations. In those jurisdictions, our liability is limited to the smallest extent permitted by law.

14. Indemnity

You agree to indemnify and hold harmless TradeForge, Tundu Trades and our officers, employees and contractors from any claim, damage, loss or expense (including reasonable legal fees) arising out of (a) Your Content, (b) your breach of these Terms, (c) your violation of any law, or (d) your infringement of a third party's rights.

15. Termination

You may close your account at any time from Settings. We may suspend or terminate your account if you breach these Terms, if we're required to by law, or if continuing to provide the Service is no longer commercially viable. We'll give you reasonable notice in good-faith terminations.

On termination: your access ends, your data is retained for 30 days then permanently erased (subject to the retention rules in our Privacy Policy), and any clauses which by their nature should survive (intellectual property, disclaimers, liability, indemnity, governing law) remain in force.

16. Governing law & disputes

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-laws principles. Any dispute that cannot be resolved through good-faith negotiation will be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya — except where local consumer-protection laws give you a non-waivable right to litigate in your home jurisdiction.

We strongly prefer to resolve disputes informally first. Email legal@tradeforge.app with the details and we'll work with you in good faith for at least 30 days before any formal proceedings.

17. Changes to these terms

We may update these Terms as the product evolves or the law requires. The "Last updated" date reflects the most recent revision. Material changes — anything that meaningfully reduces your rights or expands your obligations — will be notified to you by email at least 30 days before they take effect. Continued use after the effective date counts as acceptance.
